The Bureau of Medicine and
Surgery (BUMED) Privacy Office is responsible for the safeguarding of personally
identifiable information (PII) and protected health information (PHI) by
administering compliance programs that support federal privacy & security
laws, Department of Navy (DON) and Department of Defense (DoD) regulations by
balancing the need for collection, maintenance, use, and dissemination of
PII/PHI for military readiness programs with the rights of Military Health
System (MHS) beneficiaries, human research subjects, and the DON
employees.

HOW TO FILE A PRIVACY COMPLAINT
Privacy
complaints (e.g. HIPAA and Privacy Act) may be filed at any level of the BUMED
Organization to include the BUMED Privacy Program Office (Echelon II), Navy
Medicine Regional Commands (e.g. Naval Medical Forces Atlantic (NMFA), Naval
Medical Forces Pacific (NMFP) and Naval Medical Forces Support Command (NMFSC)
or the Privacy Office where the alleged violation occurred). In addition, individuals have a right to file
Privacy Act complaint with the Senior Component Official for Privacy (e.g.
Department of Navy Chief Information Officer) or if HIPAA related, to file a
complaint with the Health and Human Services (HHS) Office of Civil Rights (OCR)
and the DHA Privacy and Civil Liberties Office.
Complaints to the BUMED Privacy Office may be submitted via email or
mail and must include the following:
Be
made in writing and include the name, address, and other contact information of
the individual filing the complaint (indicate if home or work address);
Provide
phone number(s) (indicate if this is a cell, work or home number and if a
voicemail is permitted at this number);
Email
address and preferred method of contact to include contact information for any
other person(s) representing the complainant;
Identify
the organization or command where the alleged privacy violation occurred;
Describe
the alleged violation in detail (Date; location; whether ongoing; information
about the person, program, policy or procedure related to the complaint);
Inform
the Privacy Office where filed if a complaint was reported to any other
authority and what action, if any, was taken;
File
within 180 days of discovery of the violation if a HIPAA complaint;
Your
signature (written or electronic) and date.
HOW TO FILE A PRIVACY REQUEST
Privacy Act requests may be
filed with the System Manager of the Records, local Privacy Office where the
records are maintained, BUMED Privacy Office, or OPNAV/DNS-36.
